The property known as 24 Oak Street, Camberwell VIC 3124 be transferred to Sarah Mitchell free from any claim by James Mitchell. Sarah Mitchell shall assume liability for and indemnify James Mitchell from all mortgage obligations with ANZ Bank, and James Mitchell shall execute all documents necessary to give effect to such transfer.
2.
The property known as 5/12 Beach Road, St Kilda VIC 3182 be transferred to James Mitchell free from any claim by Sarah Mitchell. James Mitchell shall assume liability for and indemnify Sarah Mitchell from all mortgage obligations with Commonwealth Bank, and Sarah Mitchell shall execute all documents necessary to give effect to such transfer.
3.
James Mitchell shall retain the 2019 Toyota Prado (registration ABC123) as sole property, free from any claim by Sarah Mitchell. James Mitchell shall be solely responsible for all finance, registration, and insurance obligations in respect of that vehicle.
4.
Sarah Mitchell shall retain the 2021 Mazda CX-5 (registration XYZ789) as sole property, free from any claim by James Mitchell.
5.
Each party shall retain as their sole property all bank accounts and financial accounts held in their sole name as at the date of these orders (and not otherwise dealt with by these orders), free from any claim by the other party.
6.
The joint savings account with ANZ Bank (balance approximately $45,000) be transferred to James Mitchell. Sarah Mitchell shall execute all documents to give effect to this transfer within 28 days of these orders.
7.
A superannuation interest split be made of the interest of James Mitchell in AustralianSuper (USI: STA0100AU) pursuant to Part VIIIB of the Family Law Act 1975 (Cth). Sarah Mitchell shall be entitled to 20% of the base amount (approximately $57,000 based on current balance). Sarah Mitchell shall nominate a complying superannuation fund within 28 days, and the trustee shall pay the split amount to that fund.
8.
Sarah Mitchell shall retain the superannuation interest in Hostplus (USI: STA0248AU) free from any claim by James Mitchell.
9.
James Mitchell retain the ASX share portfolio (CBA, BHP, CSL) (value approximately $78,000) as sole property free from any claim by Sarah Mitchell.
10.
James Mitchell shall be solely responsible for and shall pay the Visa credit card (amount approximately $12,500) and shall indemnify Sarah Mitchell from any claim arising therefrom.
11.
Sarah Mitchell shall be solely responsible for and shall pay the HECS/HELP debt (amount approximately $18,000) and shall indemnify James Mitchell from any claim arising therefrom.
12.
Save as otherwise provided in these orders, each party shall retain all personal property presently in their possession as sole property, free from any claim by the other party.
13.
Subject to compliance with these orders, neither party shall make any further claim against the other for property settlement pursuant to s.79 of the Family Law Act 1975 (Cth).
14.
There be liberty to apply for the purpose of giving effect to or implementing these orders.
